Me and my husband have been in chapter 13 bankruptcy for 3 1/2 years now. We ran a little behind on our last months payment and talked to our lawyer and was told we could do a partial chapter 13 discharge. We can get out of bankruptcy with 75% of our debt paid and are free to go. How much will this affect out credit by getting out now vs. sticking it out the rest of the 9 months with100% paid??

My wife and I are filing chapter 13 bankruptcy. Our lawyer told us today that we would have to go to 2 hearings in court once we sign the papers for the bankruptcy. What exactly happens at these hearings? Are we going to get bombarded with questions by lawyers from the creditors? Is it a fairly smooth process I mean once we sign the papers the trustee has approved the repayment plan right?

I filed for Ch. 13 bankruptcy in 2006. My lawyer has been inaccessible since this time. I have made every monthly payment since my case was approved with all claims filed within the 90 day period and have since paid everything originally listed. In August 2009 (3 years late), I had an unsecured creditor file a claim. When I called my lawyer’s office shortly after receiving the notice, I was told that this must be paid and there was nothing they could do. I noticed on my recent claim summary that since September 2009 my payments have been going towards this claim. Deciding to do some research for myself, I noticed this was not a timely claim. After many calls to my lawyer, I explained why the claim was not any good. My lawyer FINALLY disputed this claim on December 30th, 2009 on grounds that it was late. However, he only did this because I repeatedly bugged his office and secretary about the claim I was paying on and explained that the law clearly states the time frame to file has surpassed. I finally got in touch with my trustee and she told me that it was my lawyer’s fault for waiting so long to object because it is obviously stated. She also stated that any money have paid towards this claim could not be recouped. Now I am out of about $3000. Is this a case for legal malpractice?

I have to wait until tomorrow to talk to my Lawyer.I am just wondering if anyone has still gone to college and recieved school loans while on a chpter 13 Bankruptcy?Thank you;)
We are under a plan where our bills are paid through our banckruptcy plan.We have money to pay our bills because my husband does work.

School loans don’t have to be paid back until you graduate anyway as long as you are getting the credit hrs you need. My husband was under the impression that school loans are different then other types of loans, that we know we aren’t able to take out.

I filed Chapter 13 Bankruptcy in June 2007 and I got a notice in July 2008 that my lawyer was suspended and it said I had 14 days to get a new lawyer. I stupidly did not get a new lawyer and now I am unemployed and I need my case changed. Can I hire a new lawyer to change my case?

She was quoted $1500.00. Is this price in line with what other lawyers would charge for this service?
